PY means Pacific Yoga Ltd and is the owner and operator of Pacific Yoga and the Cafe Matariki.
The yoga area is the entire area beyond the doorway situated just beyond the shoe storage, including both yoga studios, changing rooms, lobby and all other spaces adjoining them.
A member means anyone who has filled in the PY registration form and paid for a class or classes up to the point where they have used up the time they have paid for and departed from their final class.
The Terms and Conditions are incorporated into the PY registration form.
THE PACIFIC YOGA APPROACH
PY was formed from the start as an ethical, transparent company. This is defined in our core documents by our ethical statement which is a available at Reception. Please do read it. We ask all our staff and our students to follow the principles laid out in that statement and behave in accordance with them whenever they are on our premises.
Acceptance of a person as a Member is at the absolute discretion of PY. In the unlikely event that a Member continues to act in a way which is at odds with the criteria outlined in our ethical statement or conflicts with the character of the studios or the interests of other members, PY reserves the right to suspend that person’s membership. PY will on its part use its best efforts to resolve such a situation.
LIMITATIONS OF LIABILITY
We do our best to keep to our published timetables, hours of opening, teacher schedules and all other aspects of our studio operation including our website. However all or part of that may from time to time be affected by circumstances including those which are outside our control. We will do our best to alert studio customers to changes as soon as possible but we cannot be held responsible for any particular session, instructor and/or item of equipment not being available for whatever reason. We may sometimes therefore have to make alterations to the sessions, instructors and/or equipment, as well as to those ancillary facilities (e.g. showers), provided to Members. PY may change the nature and frequency of classes. PY will not be liable for any loss occasioned by such alterations, except insofar as such loss is by law incapable of exclusion. Having said that, we will always strive to behave in a fair and ethical way to our customers.
It is the Members’ responsibility to ensure that they are capable of undergoing a routine of exercises provided by any programme which they follow, or class which they attend. Members accept the risk of injury from performing exercises and are advised to consult their doctor prior to beginning any session. Members must provide full details to PY before taking part in classes of any injury, sickness or other problem which might affect them.
PY accepts no liability for loss or damage to property of Members or for injury to Members on the studio premises or outside the studio except insofar as such loss, damage or injury is by law incapable of exclusion. Personal belongings are brought onto the studio premises at the Member’s own risk.
Class size is limited and PY accepts online reservations. It will usually set aside a number of places to be filled on a “first come first served” drop-in basis. PY does not take reservations by phone.
If you have reserved a space, you need to be present, changed and ready for your class at least 5 minutes before the start of class to claim your booked place. After that time all reserved spaces are returned to “first come first served” spaces for that class and you will no longer be guaranteed your space.
Cancellation of a reservation must be made on line at least three hours before the scheduled start of the class. PY cannot take cancellations by email or telephone. If you fail to cancel and do not attend then your payment cannot be returned.
We trust members not to abuse the booking system but if any member regularly books online and fails to show up for class without cancelling, we will eventually have to block them from booking online. We believe you will do your best to avoid that happening.
Because late arrivals disturb the class, we ask you to arrive at least ten minutes before the start of class so as to be in the class, relaxed and ready to start in good time. Please keep late arrivals to a minimum. If, for reasons outside your control, you arrive after the start of a class, please wait just outside the yoga room door until the teacher shows you to a place. Please do not expect access after the breathing exercises.
It is very important that first timers should arrive at least 25 minutes before the start of their first class – giving time to fill in the registration form, discuss details with the teacher and find their way around the studio. New members must discuss any health or injury issues with a PY teacher before starting their first class.
For hot yoga classes, we recommend members wear stretch pants or shorts and a T-shirt or sports top. Please avoid bikini bathing suits. Regular swimming trunks are fine but absolutely NOT underwear. You will need a yoga mat, a full-length towel to lay on it and another towel to dry yourself after your shower. You can hire these from us if you prefer.
You will be much more comfortable if you do not eat for two hours before class. Do drink enough to make sure you are hydrated.
Members are asked to observe studio etiquette as a condition of membership. Please leave your shoes on the shoe shelves provided and turn off your mobile phone before going through the door to enter the yoga area. This is a barefoot zone but please consult staff before entering if you have any form of foot infection and if you do have a foot problem please bring clean flip-flops for this purpose.
When you enter the studio please lay out your mat between the lines on the carpet to help everyone to fit in comfortably. It is best to leave the front row nearest the mirrored wall for more experienced students so that those behind can more easily follow their example.
We intend Pacific Yoga and the Cafe Matariki to be a happy and sociable space but please remember that, for our main classes, the yoga rooms are a place where students value their peace. Please do not talk before, during or after the class while in the room and please leave quietly at the end as others may be still relaxing.
Please indicate to the teacher should you need to leave the room during the class so they can ensure you are safe. We strongly recommend that you stay for the whole class.
To repeat our advice to first-timers, for hot yoga classes, we recommend that members wear stretch pants or shorts and a T-shirt or sports top. Please avoid bikini bathing suits. Please do not wear perfumes. The warmth of the studio can spread your scent disconcertingly to other students. Can you also avoid using perfumes and spray cans in the changing rooms for the sake of other students.
For the sake of our carpets please only take water into the studio. We encourage stainless steel, BPA-free plastic or protected glass water bottles. We can provide paper cups. Please do not take plain glass or crockery into the studios.
Please do not wear watches or jewellery in class.
You will find lockers for your valuables in the changing rooms.
No sound or video recordings may be made in the yoga studios, lobby or changing rooms.
Members are required to follow the instructions of the instructor at all times.
FITNESS AND HEALTH
In their interests, before taking part in any class, new members must fill in the PY registration form in full and provide accurate answers to the questions concerning their health. They must be prepared to discuss these with the PY teachers. Members must always notify PY of any circumstances in which new or developing health problems might be adversely affected by continued exercise in the studio.
Members are advised not to undertake strenuous physical activities without first seeking medical advice if they have concerns over their physical condition. PY reserves the right to refuse access to any Member if, in its absolute discretion, it considers that the health of the individual concerned may be endangered by the use of such activities. It should be understood that PY staff may not be medically trained and may not therefore be qualified to assess whether the member or any guest is in good physical condition and/or that the member can engage in any exercise without detriment to the member’s health, safety, comfort or physical condition.
Many PY classes involve intensive exercise in a heated room. It is up to each member to assess their own health suitability for such classes and to seek appropriate further information from a PY yoga staff member if they are in doubt. Members with abnormal blood pressure and/or cardiac irregularities should not attend class unless they have current written permission from their doctor. They are expected to use reasonable judgment and if they are in any doubt, the Member should consult their doctor.
If you are pregnant, talk to our teachers about alternative postures Avoid the hotter sessions during your first trimester.
Members who are not well should have regard for others. They should not use PY’s facilities if they are suffering from any infectious or contagious illness, disease or other ailment or suffering from any ailment where there is a risk, however small, that such ailment may be detrimental to the health safety, comfort or physical condition of the other members. If there is any doubt, members should consult their doctor and must notify PY of any advice given by their doctor.
USE OF THE FACILITIES.
There is no smoking throughout the building and that includes e-cigarettes and other vaping devices.
No animals are allowed in the building except for guide dogs.
We have done our best to provide pleasing, modern, high-quality facilities. Please treat them with respect.
Children under the age of 16 may only use the studio and attend classes if accompanied by a parent or an adult with the parent’s permission.
PY reserves the right at any time to withdraw all or part of its facilities or classes for any period or periods, in connection with any cleaning, repair, alteration or maintenance work or for reasons beyond PY’s control. PY will of course endeavour to minimise any such disruption.
All property left in the studio will be kept at reception to be claimed. It will be disposed of after 4 weeks with the exception of towels which will be disposed of on a weekly basis.
Personal belongings lockers are available to members while they are attending class and are emptied every night. Any items left in the lockers at the end of the day will be placed in lost property. PY cannot be held responsible for any valuable property which is not locked in the lockers provided.
Autopay or annual membership customers – holiday membership suspensions:
We do understand that regular customers may sometimes wish to take extended holidays. To strike a balance between accommodating that and creating a logistical problem for PY, our policy is as follows:
Autopay customers – Once a year if you choose to, you may (on giving one month’s notice) suspend your Autopay membership for one calendar month from your regular payment date.
Annual membership customers – Once a year, at one week’s notice, you may tell us that you are taking the next 30 days off. We will then take account of this by extending your membership for one calendar month at the end of your year at no cost.
We do also understand that circumstances change unexpectedly.
An Autopay customer may cancel their membership after the end of their first three months. We will need a minimum of 30 days notice before your next prepayment date, given by your filling-in and handing in our cancellation form. Cancellation requests forms are processed within 48 hours of the next business day. You will receive a confirmation email upon processing.
An annual customer who needs to cancel for serious, unpredictable reasons such as medical conditions should discuss this with us as soon as possible. Within our constraints we will use our best endeavours to convert their membership retrospectively to the monthly equivalent price and refund them on that basis.
None of the other packages are refundable.
A membership package is not transferrable to any other person.
RETAIL RETURNS POLICY
The customer’s rights are defined by the Consumer Rights Act. An item sold in faulty condition can be returned within 30 days of purchase for a refund. So long as it as not been used, an item (other than yoga clothing) may be exchanged for other goods within 30 days of purchase.
In the case of yoga clothing, items should be tried on (over suitable underwear) before payment and may only be returned as above if found to be in faulty condition.
